Don't buy it without doing a compression test and a leak down test on it first. Also, THOROUGHLY inspect the underside for rust.

Pictures would help a lot, but without seeing them I really think if you can remove the muffler that's the best bet.

Yep, it's hard to believe they made that much of an improvement because even the JK was a huge leap over the TJ. I didn't think they could make it that much better, but they did. My good friend has a 4XE Rubicon and it rides like a luxury SUV. You'd never know it had solid axles under it.
